Pelvora ("we," "us," or "our") respects the intellectual property rights of others and expects users of our platform to do the same. This Digital Millennium Copyright Act Policy ("DMCA Policy") describes how we respond to notices of alleged copyright infringement and how copyright owners may submit a valid takedown notice.
1. Reporting Copyright Infringement
If you believe that content available on or through our platform infringes one or more of your copyrights, please notify us by submitting a written notice ("DMCA Notice") that includes all of the information described below. Upon receipt of a compliant notice, we will take whatever action we deem appropriate, in our sole discretion, including removal of the challenged content.
2. Requirements for a Valid DMCA Notice
To be effective, your DMCA Notice must include the following information:
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: A description of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material, such as the URL or other specific location on our platform.
- Contact information: Your name, mailing address, telephone number, and email address.
- Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or applicable law.
- Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.

We recommend submitting notices via email to ensure prompt handling. Please include "DMCA Notice" in the subject line.
4. Our Response to DMCA Notices
Upon receipt of a valid and complete DMCA Notice, we will:
- Review the notice to confirm it satisfies all requirements outlined in Section 2.
- Remove or disable access to the allegedly infringing content in a timely manner.
- Notify the user who posted the content that it has been removed or disabled.
- Provide that user with a copy of the DMCA Notice, where appropriate.
We reserve the right to reject notices that do not comply with the requirements set out in this policy.
5. Counter-Notice Procedure
If content you posted has been removed or disabled as a result of a DMCA Notice and you believe that removal was the result of mistake or misidentification, you may submit a written counter-notice ("Counter-Notice") to our designated agent at the contact details listed in Section 3.
5.1 Requirements for a Valid Counter-Notice
Your Counter-Notice must include all of the following:
- Identification of removed material: A description of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
- Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of a competent court and that you will accept service of process from the person who submitted the original DMCA Notice.
- Contact information: Your name, mailing address, telephone number, and email address.
- Signature: Your physical or electronic signature.
5.2 Processing of Counter-Notices
Upon receipt of a valid Counter-Notice, we will forward it to the party who submitted the original DMCA Notice. If we do not receive notice within the applicable statutory period that the original complainant is seeking a court order to prevent further infringement, we may restore the removed content at our sole discretion.
6. Repeat Infringer Policy
It is our policy, in appropriate circumstances and at our sole discretion, to disable or terminate the accounts of users who are repeat infringers or who are repeatedly charged with infringement. We take intellectual property rights seriously and will act accordingly against users who repeatedly violate third-party copyright or other intellectual property rights.
7. Misrepresentation
Please be aware that submitting a DMCA Notice or Counter-Notice containing materially false statements may expose you to liability, including for damages, costs, and attorneys' fees. If you are uncertain whether a particular use constitutes copyright infringement, we recommend consulting a qualified legal professional before submitting any notice.
8. Modifications to This Policy
We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to the platform. Your continued use of the platform following any changes constitutes your acceptance of the revised policy. We encourage you to review this policy periodically.
